It seems that the enforcement of real estate licensing rules in the Philippines is a big joke. Almost anybody can sell, advertise and engage in real estate transactions. Even major real estate companies and developers employ unlicensed agents.

If you're a buyer, seller or real estate licensee, are you willing to work with an agent without a valid real estate license?

I'd rather work with licensed brokers, preferably from those PAREB (Philippine Association of Real Estate Brokers). They know the "ethics" of the industry, or if new in the organization, willing to learn. And always on their toes not to violate our "rules". Colorums are dangerous! Work with them at your own risk. In fairness, some of them seem professional. But you really have to be careful. Some of them really want to license, awaiting further announcements from PRC on how to apply. From experience though, even those who handle high-end condos, even if licensed, may not so professional in the business. Obviously, they are not from PAREB. I have worked with some from REBAP, too, and those I dealt with are also professionals; they too, know the ethics of the business.

I know the courts and the legal system in PI is a failure for unethical business practices especially if you don't have unlimited resources and connections.

If it's me, I will simply post names, events and tell my story on the web, shame and expose the perpetrator and hopefully others won't have to deal with that individual again.

Everyone is crying for change and professionalism and nothing is more powerful than the truth.

Hi Mike, wether we like it or not we are working with UNLICENSED REAL ESTATE AGENTS/BROKERS before and even now since DTI before had no bones to implement the laws but with the newly RESA-Rep. Act. 9646 we are hoping that everything will be handle by PRC well. Even big developers are hiring unlicensed agents up to now...

We are encouraging all unlicensed brokers/agents or pretending to be a broker to apply a REAL ESTATE LICENSURE EXAMINATION in Professional Regulation Commission after the implementation of the IRR-RESA Rep. Act 9646 maybe on MARCH 2010 or just wait for the final announcement from the PRC. We want them to be part of us as a LICENSED REAL ESTATE BROKERS/SALESMAN legally and they should pass the BOARD EXAM first before doing REAL ESTATE BUSINESS. In realty we had a bad experienced as a LICENSED BROKER coz we are treated as a second class citizen in a certain developer- MANDARA WATERFRONT simply because they prioritized their colorum inhouse agents who are unethical agents. As of now we are waiting for the IRR from the PRC to fully implement the REP. ACT 9646 or the REAL ESTATE SEVICE ACT by March 2010. Since REAL ESTATE is professionlized thru PRC I think the RULE OF LAW will be implemented soon and nobody are above the LAW..

REP. ACT. - SEC. 29. Prohibition Against the Unauthorized Practice of Real Estate Service. - No person shall practice or offer to practice real estate service in the Philippines or offer himself/herself as real estate service practitioner, or use the title, word, letter, figure or any sign tending to convey the impression that one is a real estate service practitioner, or advertise or indicate in any manner whatsoever that one is qualified to practice the profession, or be appointed as real property appraiser or assessor in any national government entity or local government unit, unless he/she has satisfactorily passed the licensure examination given by the Board, except as otherwise provided in this Act, a holder of a valid certificate of registration, and professional identification card or a valid special/temporary permit duly issued to him/her by the Board and the Commission, and in the case of real estate brokers and private appraisers, they have paid the required bond as hereto provided.

Let's see how they will enforce this new law.

At the end of the day, it is up to the consumers if they want to work with someone with or without a valid real estate license. One thing we can do is educate them as much as we can.
