How Will You Prove that You Are the Source of the Buyer?

Compensation disputes may arise when more than one broker claim to work with the same buyer.

 

As a real estate professional, how will you prove that you are the one who actually produced the buyer?

During the 1st viewing, I prepare a client registration & viewing report which I ask the buyer to sign/acknowledge that I am the broker that he viewed the property with. This client registration form is also acknowledged by the seller or the seller's exclusive broker. There is a statement in the form that the seller and buyer agrees that I am the broker they agree to work with.

By dealing only with my fellow licensed real estate brokers who are also members in good standing of official Real Estate Organizations, I am assured of integrity and honesty in our transactions. We also have broker agreements between us if there is more than one licensed broker facilitating the sale and we need to outline the sharing agreement. This applies to general brokerage (resale/rentals).

For developer properties, a client registration form is also submitted, but this is usually just valid for 30 days. It is therefore essential that you maintain a good relationship with your buyer so that if his buying process exceeds 30 days, you can ask him to sign another registration form to acknowledge that you are the seller's representative he prefers to work with. This form is provided by the developer.
