Non-License Real Estate Practitioners in the Philippines, what are the exemptions?

Is an in-house agents or sales people of real estate developer are exempted of getting a license real estate salesman in DTI?

I seen a lot of this case in Luzon, here in Cebu, We start campaigning on this and some of the know developer we are still observing them and given them few months to license there in-house salespeople before we make complain to DTI.

Other than know exemption of selling a property if your not the owner likes:
- For Sale By Owner (FSBO)
- Special Power of Attorney from the property owner

What else can you add to the exemptions?

Hi Samuel,

How can you verify status of a Philippine real estate license? Is there an online database somewhere? Will it show the licensee's record including citations, violations and pending cases?

I can't find this database on the PRC's website.

If the industry is really serious on lifting it's standards, this is one of the first thing they should implement. Consumers should be able to verify a real estate license easily.

Hi Mike,

We are still looking forward to that moment where we can search in the Department of Trade & Industry (DTI) a summary of license Brokers & Salesmen.

Maybe you can recommend something with your standard practice there in U.S. so we can make it as benchmark and suggest it to DTI and soon to PRC once there consolidation start.

My only concern now is BIG Developers is employee through a MOA with there sale people and they call them in-house sales force and most of them not even a license real estate salesmen. I tried to read before but i do not see any exemption on that. They get monthly allowance and commission.

I hope they can start licensing there people to make everything fair.

Are these unlicensed "in-house" salespeople allowed to represent multiple developers or are they exclusive to one developer who employs them?

Is this approach legal in the Philippines? If not, what government agency should be enforcing the rules?

Building an online directory of real estate licensees is not that difficult. I am not sure why the regulating body doesn't have it at this day and age. All they have to do is enter the licensee's record on the system as soon as they issue the license. Any disciplinary action imposed on the licensee can also be posted. The different Boards and associations should be pushing for this.

I agree with you. If others can sell properties for a principal without a license, then why have a license in the first place?

hi sir the PRC or Professional Regulation Commission will porvide a ROSTER list of all Real Estate licensed Broker after the formulation of IRR of THE RES LAW- Rep. Act. 9646 maybe on March 2010 but for the moment the certified real estate broker names are listed in DTI-Dept. of Trade and Industry- For the protection of investors and plain users of real estate homes

This year (2009) will be so challenging for all of us.......as we also need to start cleaning-up the WEB with thousands of colorum / unlicensed real estate practitioners. Thou we have made some successes for the year 2008 using the diplomatic approach - pero kulang pa. Sana, we have the records to show........how many licensed r.e. salesman registered / recorded with DTI (maskin dti-cebu office lang) for the year 2007 compared with 2008 - if we only have the numbers....you will be shocked with the percentage of the increase.

With your leadership at PAREB-CEREB as the 2ND-VP.......blend-in with the drive of the FIRST-VP........im sure we could create more positive changes and weed-out all the colorums on the NET.

The COMMITTEE on ANTI-COLORUM TASKFORCE must be strengthen and should initiate a courtesy-call with the head of DTI-BTRCP soonest....... discuss the plans and strategist and implement the LAW !!!

Hello Fellow Realtors and Comrades in the industry;

Good day to all and of course Happy New Year!!

I am happy to note that the discussion on this topic is of primal relevance on the onset of the year 2009: HOW TO GET RID OF COLORUM REAL ESTATE BROKERS IN THE PHILIPPINES!

There is and has been a tremendous rounds of discussion on this matter but until now, COLORUM brokers keep on increasing in numbers particularly in the web.

If we recall these past few months, DTI has initiated policing the presence of colorum brokers and made outright apprehensions in project exhibits in malls particularly in SM, Cebu. But we have to accept it, DTI has no adequate people to police, apprehend and no less penalize these colorum brokers with their numbers on a daily basis and on the nationwide scope. In other words, we might be mopping the waters on the floors without fixing the main leak in the rotten pipe!

Maybe we can adopt other options in solving this problem.

First, when I say, we have to GET RID of these unlicensed brokers, I do not mean to stop them from practicing their trade where they get their daily subsistence perhaps. I only mean to LEGALIZE their practice to be professional and be FAIR with the licensed ones. How we can do this?

We have our National Boards - PAREB, NREA,REBAP, and others. They have tried to lobby in our Gov't Houses but to no avail. (Pardon the lenghty discusssion on Philippine style of politics where many of our developers in congress are also colorums!)

Hence, maybe we can start in the LOCAL level with our LOCAL BOARDS.

First, our boards should find time to sit down with the local Register of Deeds and to arrange an agreement that ALL REAL ESTATE REGISTRATIONS, DOCUMENTATIONS AND TRANSFERS, SHOULD CARRY AN IMPRIMATUR OF A LICENSED BROKER.

Second, for a signature fee, a colorum broker can only have his transaction entertained by the Register of Deeds when it has passed and has been reviewed and finally given an imprimatur by the licensed broker . This should apply to all - be you a property owner, developer, holder of SPA, bank personnel, as long as you are not licensed for the realty practice. (Ref. RA 039).

Third, this procedure will eventually encourage the colorum broker - if he wants the whole pie of his commission intact by not shelling out signature fee - to acquire a license and be at par and fair with the licensed brokers.

Finally, only and only then can we see a clean playing field for the real estate industry.

Who are these developers?

As I have mentioned on my prior post, an online license database will make a big difference. Brokers can easily post a link to their license record on all their marketing materials including websites and ads. Consumers can then easily spot unlicensed individuals instantly.

One question to all REALTORS.

Are Licensed Real Estate Salesman allowed / authorized to advertise a property listing/s in the newspaper or on the web?

If they are licensed, yes. But the ads and marketing pieces have to be reviewed and approved by the employing broker first. And the salesman and broker's license and company name must be included.

Dear Colleagues,

Our government agencies who are policing this non license real estate salespeople is under man. And i think with their plenty of Jobs they are not focusing this issue of anti-colorum drive.

I like the opinion with Jon, we can start it by strengthening our campaign in our local board, by coming up a join resolution and tap the help of media to voice out the Law and advantage of dealing with no license broker.

And strengthening our marketing to promote license salespeople in the real estate industry.

Next, we encourage the local newspaper to screen, filter online advertiser member, which only license real estate brokers/salesmen can post by requiring their individual license post after their name.

Guys, what we need is to market/PR our profession just like we are good in packaging the project of the developers we market. I encourage everyone to market our profession as ONE of the most promising profession this 2009, with high regards and professionalism, and most rewarding & challenging career.

And for Cebu, we can initiate to have a Realtor Week, just like we have Rotary International Week.

Then perhaps people start of thinking professionalizing and getting license.

We cannot expect the government to do all or most of the work. If the industry is serious, the real estate boards and their members should build the system of transparency and accountability.

Before we even exert our efforts and resources on trying to catch those unlicensed individuals, we should first show to the public who are licensed and the benefits of working with one.

Is there a national database of all licensees in the Philippines? Who maintains it?
If the broker or salesman is not on the active list, then the consumers can decide if they still want to work with an unlicensed individual or report them to the authorities. This will not only help the consumers, it will also encourage everyone to get their license.

The directory should work something like this:

The directory can be enhanced with more details including disciplinary actions imposed on the licensee.
