Exactly Mike. Accountability is the first thing we are striving for here and the new RESA Act is just our opening punch. It will be up to our elected officials to enforce this new law and all the contents of it. Open Forums, Blogs and all other forms of getting the message out will help in promoting Broker accountability.

It is up to all Licensed Brokers to get off the sidelines and into the game by providing and sharing some of their experiences and views. Please, let us all take an active part in bringing new life and legitimacy into our Philippine Real Estate Industry so we may be "Proud Professionals". I know I am already.

Thank you Maris.

Here's my take on this issue and I hope others can add to it.

A license is not a guarantee of character but it promotes accountability. A licensed broker will at least think twice to do bad things since it may cost him his license. No broker wants to be known for having a revoked or suspended license.

Licensees whether in real estate or other industry are usually regulated by a governing body or organization. They are subject to some standards (i.e. code of ethics), continuing education, training and other rules.

Although I don't believe in too much government, regulations can be friendly if properly implemented. Regulations can also be damaging if they favor certain sectors. This happens all the time when special interest groups lobby and bribe congress. I hope this RESA law is a good law. If it is, let's hope it will be strictly enforced.

By discussing industry related issues like this, people will start to see that awareness can make a real difference.

If real estate clients will deal with Realtors or certified real estate licensed brokers with the newly Real Estate Service Act - Rep. Act. 9646 they are seccured and protected by our government to finalzied scrupulous licensed brokers with certain penalties with imprisonment stated in RESA. Secondly clients can run after UNETHICAL licensed brokers and it will result to licensed cancellation. Then licensed brokers are contributing to our economy thru renewing our licenses and paying huge taxes. With the Rep. Act. 9646 Licensed brokers now are more aware and ethical in dealing with their clients. Our world is not perfect there are some unethical licensed brokers selling but they should watch their step coz the Phil. Regulation Commission will run after them with our new law the REP. ACT 9646.

We are inviting all Real Estate Unlicensed agents to apply licensed at Philippine Regulation Commission soon coz this is already a LAW and we are required to abide this law and be part of us as a Licensed practitioner.....we welcome unlicensed agents in Manila Board of Realtors as an associate members in preparation of PRC Licensure exam.....JOIN US.........

hi, before almost all developers hired unlicensed agents coz the REAL ESTATE SERVICE ACT - Rep. Act. 9646 was signed by Pres. Arroyo last July 2009 into LAW, this is a new law and still waiting for the Implementing guidelines upon the appoinment of the PRC Real Estate Board, Developers now are aware of this law since they are under CREBA and they are preparing for this changes to happen soon and we are inviting all unlisenced agents praticing real estate to join us in MANILA BOARD OF REALTORS at least 2nd year college to join us as an associate member in preparation of PRC LICENSURE exam.

The problem here in the Philippines, the DEVELOPERS allowed to accredit them the non-licensed agents and they did more favors for them.

Perhaps someone can answer this.

Why are real estate developers in the Philippines allowed to hire and pay unlicensed agents? Are these agents paid a salary, commission or both? What is their employment status with these developers? Are they employees or are they acting as independent contractors like real estate brokers do?

Are the developers exempted from the broker licensing rules?

yes I agree with maris that the enactment of RESA 9646 will slowly eradicate unlicensed broker in the future.however there are some people that they can still sell without a license.Hopefully with full implementation of RESA ,HLURB WITH THE HELP OF DIFFERENT BROKER ASSOCIATIONS WIL TRULY IMPLEMENT THIS NEW LAW OR ELSE IT WILL BE JUST BE A LAW WITHOUT TEETH.

This is so obvious. If you don't have a license, of course you will say negative things about licensees. If you do have a license, you will be against practitioners without a license. That we all know.

But the main issue remains that the law requires a valid real estate license if you're in the real estate business. If you think you can get away with it by saying you're honest and exceptional so you can operate without a license, then you're simply fooling yourself. Wake up and act like a true professional by getting your license.

yes! i agree w/antonio rances.me as direct in-house marketing I experience comments from my clients na niloko sila ng mga broker and license realtor pa to be specific sa property na kinuha nila,yah! hindi naman lahat.pero that's the comments of my clients.peace..
